2. Service Description
Wavvy provides a WhatsApp Business automation platform that enables users to:
- Manage multiple WhatsApp sessions
- Send bulk messages and create campaigns
- Manage contacts and message templates
- Track courier orders and automate notifications
- Use AI-powered chatbots and auto-reply features
- Access our API for custom integrations
3. Account Registration and Eligibility
3.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use Wavvy. By registering, you represent and warrant that you meet these requirements.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information is accurate and up-to-date
3.3 Phone Verification
We may require phone verification via WhatsApp to activate certain features or plans. You consent to receive verification messages from us.
4. Subscription Plans and Billing
4.1 Plans
We offer multiple subscription tiers (Free, Starter, Professional, Business, Enterprise) with varying features and usage limits. Plan details and pricing are available on our pricing page.
4.2 Payment
- All fees are in Pakistani Rupees (PKR) unless otherwise stated
- Subscription fees are billed monthly in advance
- Payment is required before accessing paid features
- We reserve the right to change pricing with 30 days notice
4.3 Usage Limits
Each plan has specific limits on:
- Number of messages per month
- Active WhatsApp sessions
- Contacts and templates
- API requests per hour
- Storage space for media files
Exceeding these limits may result in service suspension until you upgrade or the next billing cycle.
4.4 Refunds
Subscription fees are non-refundable except as required by law or at our sole discretion.
5. Acceptable Use Policy
Important: Violation of this policy may result in immediate account suspension or termination.
5.1 Prohibited Activities
You agree NOT to use Wavvy to:
- Send spam, unsolicited messages, or engage in mass messaging to non-consenting recipients
- Violate WhatsApp's Terms of Service or Business Policy
- Distribute malware, viruses, or malicious content
- Engage in fraudulent, deceptive, or illegal activities
- Harass, threaten, or abuse others
- Impersonate any person or entity
- Collect or harvest user data without consent
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to our systems
- Resell or redistribute our services without permission
5.2 WhatsApp Compliance
You must comply with all WhatsApp policies, including:
- Obtaining proper consent before messaging users
- Respecting opt-out requests immediately
- Not using automated or bulk messaging for spam
- Following WhatsApp's Business Policy guidelines
5.3 Content Responsibility
You are solely responsible for all content you send through Wavvy, including messages, media files, and templates. We do not monitor or control user content but reserve the right to remove content that violates these Terms.
6. API Usage
If you use our API:
- You must keep your API key confidential
- You are responsible for all API requests made with your key
- Rate limits apply based on your subscription plan
- We may throttle or block excessive API usage
- API access may be revoked for violations
7. Intellectual Property
7.1 Our Rights
Wavvy and all related trademarks, logos, and content are owned by us. You may not use our intellectual property without written permission.
7.2 Your Content
You retain ownership of content you create or upload. By using Wavvy, you grant us a limited license to process, store, and transmit your content solely to provide our services.
8. Third-Party Services
Our platform integrates with third-party services (WhatsApp, AI providers, courier services). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their availability.
9. Service Availability and Modifications
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We may modify, suspend, or discontinue features at any time
- We reserve the right to update these Terms with notice
10. Termination
10.1 By You
You may terminate your account at any time through your dashboard settings. Termination does not entitle you to a refund.
10.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or our policies
- Engage in fraudulent or illegal activities
- Fail to pay subscription fees
- Pose a security risk to our platform
10.3 Effect of Termination
Upon termination:
- Your access to Wavvy will be immediately revoked
- Your data will be deleted according to our Privacy Policy
- You remain liable for any outstanding fees
11. Disclaimers and Limitations of Liability
11.1 Service "As Is"
Wavvy is provided "as is" without warranties of any kind, express or implied. We do not guarantee that our service will be error-free, secure, or uninterrupted.
11.2 Limitation of Liability
To the maximum extent permitted by law, Wavvy shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from third-party services or integrations
- Damages exceeding the amount you paid us in the past 12 months
12. Indemnification
You agree to indemnify and hold Wavvy harmless from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you send through our platform
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through:
